Terms of Service – Ausamics

1. Overview

This website and online store (the Services) are operated by Ausamics (“we”, “us”, “our”).
By accessing or using the Services, creating an account, requesting quotations, or purchasing products, you agree to be bound by these Terms of Service (Terms). If you do not agree, you must not use the Services.

These Terms apply to all users of the Services, including customers, visitors, and account holders.


2. Eligibility & Accounts

You must be at least 18 years of age and legally capable of entering into binding contracts to use the Services.

You are responsible for:

  • Maintaining the confidentiality and security of your account credentials

  • All activities conducted under your account, whether authorised or not

We reserve the right to suspend, restrict, or terminate accounts where misuse, unauthorised activity, or breach of these Terms is suspected.


3. Changes to the Services & Terms

We may update, modify, suspend, or discontinue any aspect of the Services, products, pricing, or these Terms at any time by publishing an updated version on the website.

Your continued use of the Services following any update constitutes acceptance of the revised Terms.


4. Products, Use & Information

Ausamics supplies laboratory reagents, chemicals, culture media, and scientific materials.

Unless explicitly stated otherwise in writing:

  • Products are supplied for laboratory, research, industrial, or professional use only

  • Products are not intended for human or veterinary consumption

  • Products are not supplied as therapeutic, diagnostic, or medical goods

All product descriptions, specifications, and technical information are provided in good faith. Minor variations in packaging, appearance, labelling, or specifications may occur between batches. Product specifications, formulations, or availability may be changed or discontinued without notice.

Customers are solely responsible for ensuring products are suitable for their intended use and compliant with applicable laws and regulations in their jurisdiction.


5. Orders, Acceptance & Cancellation

Any order placed through the Services constitutes an offer to purchase.

We accept orders only when:

  • An order confirmation is issued, or

  • The order is dispatched

We reserve the right to refuse or cancel orders at our discretion, including due to stock limitations, pricing or listing errors, regulatory restrictions, payment issues, or compliance requirements. Where payment has been taken, a refund will be issued.

Requests to cancel orders must be made before dispatch by contacting sales@ausamics.com. Cancellation after dispatch cannot be guaranteed.


6. Pricing, Taxes & Payment

  • Prices are displayed exclusive or inclusive of taxes as indicated

  • Shipping and handling charges are shown at checkout

  • Payments are processed securely via third-party payment providers

  • Ausamics does not store full credit card details

We reserve the right to correct errors in pricing or product information and cancel affected orders where necessary.


7. Shipping, Risk & Title

Orders are dispatched from Australia unless otherwise stated.

  • Delivery timeframes are estimates only and not guaranteed

  • Risk passes to the customer upon delivery to the nominated address, including where Authority to Leave is selected

  • Title to goods passes once full payment has been received

Shipping and delivery are governed in conjunction with our Shipping & Returns Policy.


8. Use of the Services

You agree not to:

  • Misuse or interfere with the Services or their security

  • Attempt unauthorised access to systems or data

  • Upload malicious code or harmful material

  • Scrape, harvest, or reproduce content without permission

  • Infringe intellectual property rights

  • Use the Services in breach of applicable laws or regulations

We may suspend or terminate access without notice where misuse or breach is suspected.


9. Third-Party Services & Links

We rely on third-party service providers for ecommerce hosting, payment processing, logistics, analytics, advertising, and customer support.

Third-party links are provided for convenience only. We do not control and are not responsible for third-party content, systems, or practices.


10. Personal Information

Our collection, storage, and use of personal information are governed by our Privacy Policy, which forms part of these Terms.


11. Warranties & Statutory Rights

To the maximum extent permitted by law:

  • All implied warranties, representations, or conditions relating to the Services or products are excluded

Nothing in these Terms excludes, restricts, or modifies rights or remedies that cannot be excluded under applicable law, including Australian Consumer Law.


12. Limitation of Liability

To the maximum extent permitted by law:

a) Ausamics is not liable for any indirect, incidental, special, or consequential loss, including loss of profit, revenue, business opportunity, data, or goodwill

b) Ausamics’ total aggregate liability arising from the Services, products, or these Terms is limited (at our option) to:

  • Repair or replacement of the goods, or

  • Refund of the purchase price paid

This clause does not apply to liabilities that cannot be limited by law.


13. Indemnity

You agree to indemnify and hold harmless Ausamics from all claims, losses, damages, liabilities, costs, and expenses arising from:

  • Your breach of these Terms

  • Misuse or improper handling of products

  • Breach of applicable laws or regulations

  • Unauthorised use of the Services


14. Intellectual Property

All content on the Services, including text, images, technical data, documents, trademarks, logos, and website design, is owned by or licensed to Ausamics.

No content may be copied, reproduced, distributed, modified, or commercialised without prior written permission, except for personal, non-commercial use.


15. Termination

We may suspend or terminate access to the Services at any time, with or without notice.

Any provisions which by their nature should survive termination, including limitation of liability, indemnity, and governing law, will continue to apply.


16. Governing Law & Jurisdiction

These Terms are governed by the laws of Australia.
You submit to the exclusive jurisdiction of the courts of Australia and the state or territory in which Ausamics operates.
